This is a legal agreement between you and Legacy Financial Services (“we,” “our,” or “us”) that outlines the terms and conditions governing your access and use of our services.

By using Legacy Financial Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions along with our Privacy Policy.

If you do not agree with these Terms and Conditions or our Privacy Policy, you must not use or access our websites or services.

1. Our Services

Legacy Financial Services works with individuals, households, and businesses to help manage and simplify monthly bills such as electricity, gas, water, internet, cable, satellite, and cellphone services.

We use our authorized partner funds to pay your bills directly to your providers. After the bill is confirmed as paid by your provider, you reimburse us the agreed portion.

We do not guarantee that every bill submitted will be successfully processed, and in such cases, you will not owe us anything.

2. Your Information & Participation

You agree to provide accurate and current information, including but not limited to:

Name, address, phone number, and email

Bill copies or account details required for payment processing

Your personal information is kept confidential and is only used for providing services and internal operations.

Communication Consent: You agree to receive emails, phone calls, or text messages regarding your account, payments, and services.

SMS Disclosure: By providing your phone number, you consent to receiving updates and notifications related to your account. Message and data rates may apply. Reply “STOP” to opt-out or “HELP” for assistance.

3. Costs to You

There are no upfront fees.

You reimburse us only after we have successfully paid your bill.

Our service fee is clearly communicated in advance (e.g., a set percentage or amount of the bill payment).

If your bill is not paid by us, you owe us nothing.

4. Billing & Payments

Once your bill is confirmed as paid by your provider, we will issue you an invoice.

You agree to reimburse us within the stated period (typically 24 hours after confirmation).

Payments can be made via Zelle, bank transfer, cashier’s check, or other approved secure methods.

Late Payments: Failure to pay on time may result in late fees, suspension of services, or collection efforts.

Non-Payment & Collections: If you do not pay as agreed, Legacy Financial Services reserves the right to assign your account to collections. You agree to cover all reasonable costs associated with collection, including attorney’s fees, court costs, and collection agency fees (up to 35% of the debt).

5. Cancellations & Refunds

You may discontinue services at any time by notifying us in writing (email acceptable). However, you remain responsible for reimbursing any outstanding payments made on your behalf.

If your provider reverses or refunds a payment, you are required to notify us immediately. Adjustments or credits will be applied as appropriate.

6. Limitation of Liability & Indemnification

Legacy Financial Services is not liable for any indirect, incidental, consequential, or special damages resulting from the use of our services, including but not limited to errors by your service provider, delays, or system outages.

By using our services, you agree to indemnify and hold harmless Legacy Financial Solutions, its officers, employees, and agents from any claims, liabilities, or damages resulting from your use of our services.

7. Legacy Financial Services is Not a Financial Advisor

We do not provide financial, legal, or tax advice. Our services are limited to managing bill payments on your behalf. Please consult qualified professionals for financial or legal advice.

8. Prohibited Use

You agree not to:

Use our services for unlawful or fraudulent purposes

Misrepresent information about yourself or your accounts

Attempt to access or interfere with our systems or networks

Harass or abuse our employees or partners

Engage in activities that may harm the reputation or operations of Legacy Financial Services.

9. Rights You Grant to Us

By submitting your bills, you authorize Legacy Financial Services to act on your behalf solely for the purpose of processing and paying those bills.

10. Modifications

We reserve the right to modify or update these Terms and Conditions at any time without prior notice. Continued use of our services after updates constitutes acceptance of the revised terms.

11. Applicable Laws

This agreement, its interpretation, and its enforcement are governed by the laws of the State of Vermont. Venue shall be in the state and federal courts of Chittenden County, Vermont.

12. Dispute Resolutions

Any disputes will be resolved through binding arbitration in Vermont. You waive your right to a jury trial or class action. Claims may only be brought on an individual basis.

13. Third Party Links or Services

Our website may reference or link to third-party services. Legacy Financial Services is not responsible for third-party content, offers, or agreements. Any dealings with third parties are solely between you and the third party.

14. Account Security

If you create an account with us, you are responsible for maintaining the confidentiality of your login credentials. If compromised, you must notify us immediately.

15. Disclaimer of Warranties

Our services are provided “as-is.” We do not guarantee error-free or uninterrupted service. We also cannot guarantee that your provider will never reverse or adjust a payment once it has been processed.

16. Miscellaneous

If any provision of this agreement is found invalid, the remaining provisions will remain in effect.

Failure to enforce any term of this agreement does not waive our right to enforce it in the future.
